1.1 - Vertical Rio Serviços de Turismo LTDA, CNPJ 48.329.091/0001-30, is a registered tourism agency with Cadastur – Ministry of Tourism, and is not an air operator of the commercialized sightseeing flights;
1.2 – Vertical Rio operates in partnership with duly certified air operators authorized by the National Civil Aviation Agency (ANAC), including but not limited to Helinews Serviços de Aerocinematografia e Reportagem LTDA, CNPJ 09.321.147/0001-58, and Maricá Táxi Aéreo LTDA, CNPJ 31.548.241/0001-01. These operators are exclusively responsible for conducting the flight operations, including the provision and maintenance of aircraft, crew, safety procedures, and compliance with applicable aviation regulations.
1.3 – All pilots are ANAC-certified, aircraft are approved for specialized air services, and operational procedures are authorized by ANAC. Vertical Rio is responsible solely for the tourism intermediation, commercial promotion, reservation management, and customer service. Therefore, any liability arising from the actual air transport operation, including safety, navigation, and execution of the flight, lies exclusively with the certified air operator responsible for that specific flight.
2.1 - Vertical Rio works with advance online reservations;
2.2 - All payments are conducted in Brazilian Reais (BRL);
2.3 - Reservations are confirmed after processing online payment via PayPal, bank transfer/Pix (domestic transactions), Stripe, or other approved payment methods;
2.4 - No reservation is confirmed without the receipt of a confirmation email;
2.5 - Vertical Rio does not require a minimum number of passengers for reservations and offers shared flights, reserving the right to allocate other passengers on the aircraft, except in private flight bookings;
2.5.1 - While no minimum number of passengers is required for reservations, there is a minimum requirement for each flight, depending on the aircraft model used for the activity;
2.5.2 - Private flights must be requested in advance, with a quote sent for the reservation of the remaining seats;
2.6 - Passengers under 18 years old and over 16 years old may fly with the signing of a Responsibility Agreement by their respective guardian, who must be present on-site;
2.6.1 - If parents or legal guardians cannot be present, the participant must provide a Responsibility Agreement signed by one of the parents or legal guardians, along with a photocopy of the valid identification document of the parents or legal guardian. Necessary documentation should be provided in advance during the reservation process;
2.7 - Passengers under 16 years old may only fly accompanied by their legal representative;
2.8 - Passengers under 12 years old may only participate in flights with the doors on;
2.9 - Refunds are subject to the timeframes of the payment platform, banking institutions, and credit card operators;
2.10 - On hold reservations (with payment processed) have a validity of 12 months from the payment date to reschedule the flight. After this period, the paid amount cannot be refunded or used as credit for another reservation;
2.11 - Dynamic pricing: The price list may vary depending on the season of the year, days of the week, time of the day, and demand, and may be subject to adjustments regularly;
2.11.1 - In case of rescheduling flights to a period with higher prices, the passenger will be subject to a price difference charge;
2.12 - In case of payment disputes with the bank and/or credit card operator after the service has been provided, Vertical Rio will promptly refute such claims, including through legal actions on civil courts to seek compensation for losses and damages, and if necessary, on criminal courts;
2.13 - An online booking fee may be charged for reservations made through our digital platforms. The exact amount of this fee will be clearly disclosed during the checkout process, prior to payment confirmation;
2.14 - Vertical Rio uses payment systems with fraud protection measures and may cancel bookings or flights in case of suspected fraud or payment inconsistencies, without the obligation to disclose the reasons.
3.1 - To ensure the best service, punctuality for check-in is essential for conducting the safety briefing and preparation before the flight with all necessary safety measures;
3.2 - A valid photo identification document must be presented at check-in for all passengers (passport for foreign passengers);
3.3 - All passengers will participate in a safety briefing conducted by trained professionals, where they will learn all normal and emergency procedures, as well as the handling and operation of safety equipment;
3.4 - Regardless of the contracted route, certain points may have visibility limitations and flight restrictions due to operational reasons;
3.5 - The contracted flight time is measured from engine start-up to engine shutdown and is subject to air traffic flow conditions, air traffic control authorizations, and weather conditions;
3.5.1 - The contracted flight time is approximate and may vary by up to 5 minutes, more or less, due to operational reasons;
3.6 - All passengers must demonstrate that they are physically fit for the flight, in accordance with safety instructions;
3.6.1 - Vertical Rio does not recommend the activity for individuals with medical restrictions and/or reduced mobility that could jeopardize the participant’s safety. Vertical Rio does not have the authority to approve the boarding of pregnant women, individuals in pre-operative or post-operative conditions, or those with any special conditions. Each passenger is responsible for the decision to board, and should consult their respective doctors and/or competent authorities;
3.6.2 - Vertical Rio reserves the right to remove or refuse any passenger who appears to be under the influence of drugs or alcohol, posing a risk to the flight’s safety and/or other passengers;
3.7 - Passengers acknowledge that, despite the existence of rigorous, standardized, and professionally implemented safety procedures, all aviation activities inherently involve risks. These may include unforeseen events or incidents, including serious accidents, which, although rare, cannot be entirely eliminated. By agreeing to participate in the activity, passengers accept these risks as an inherent part of the aerial experience;
3.8 - All passengers commit to following the instructed safety procedures and acknowledge that any actions contrary to the received information and guidance can cause harm to personal safety, the environment, and third parties, for which they will assume full responsibility;
3.9 - The distribution of passengers in the aircraft seats is based on weight and balance and is solely at the discretion of the pilot in command or any other qualified person designated by the pilot in command or certified air operator, in accordance with their prerogatives under the regulatory body;
3.10 - The aircraft model used for each flight is determined based on operational factors and cannot be chosen by passengers;
3.11 - Maximum weight per seat: 110kg (not exceeding 280kg for all 3 seats in R44 model aircraft);
3.11.1 - During the reservation process, passengers will be asked to provide their estimated body weight, which will be used as a parameter for preliminary weight and balance calculations. It is the sole responsibility of the passenger to ensure the accuracy of this information. In accordance with ANAC regulations, all passengers’ weights will be measured on a scale during check-in. If a passenger’s measured weight exceeds the maximum per-seat limit, they will not be allowed to board, and the amount paid will not be refundable. Passengers are strongly encouraged to consult us in advance if there are any doubts regarding this requirement or the possibility of aircraft repositioning;
3.12 – Flights may be delayed due to operational reasons, including but not limited to adverse weather conditions, air traffic control, technical maintenance, boarding logistics, aircraft repositioning, and any other circumstances that may impact the safe and efficient execution of the flight. In such cases, passengers will be informed as early as possible, and Vertical Rio will make its best efforts to minimize any impact and carry out the flight as soon as feasible. These delays do not entitle passengers to compensation for losses, damages, or refunds, except in cases expressly provided for in these Terms and Conditions.
4.1 - Boarding with any loose object or equipment inside the aircraft, as well as wearing flip-flops, sandals, or open shoes that can easily come off, is prohibited and may compromise flight safety;
4.2 - All equipment, cameras, and cell phones must use our approved supports for the flight. The pilot in command is responsible for the final approval of any item on board, and the responsibility for handling objects inside the cabin lies solely with the passenger;
4.3 - All passengers will be instructed in the use of additional safety equipment and must demonstrate their ability to handle them under normal and emergency conditions.
5.1 - GoPro rental:
5.1.1 - GoPro cameras may be rented for exclusive use with Vertical Rio-approved mounts and cannot be shared during the flight;
5.1.2 - Images captured during the flight will be provided digitally through a link sent by email within 48 hours after landing;
5.1.3 - Images will be available for download via the provided link for a predetermined period as stated in the email, after which they will be permanently deleted automatically.;
5.1.4 - Vertical Rio is not obligated to archive images; therefore, re-sending files will not be possible if the passenger fails to download within the predetermined deadline in the email;
5.1.5 - While Vertical Rio offers high-quality equipment, due to the nature of the activity, in the rare event of equipment malfunction or technical failure beyond our control, the rental fee will be refunded, and there will be no refund of the flight fee;
5.1.6 - If the camera’s images do not meet the passenger’s expectations due to misuse or lack of knowledge, the passenger will not be eligible for a refund of the paid amount;
5.1.7 - In case of equipment unavailability due to maintenance or flight rescheduling, the rental fee for the equipment will be fully refunded.
5.2 - “Shoe Selfie Pass”:
5.2.1 - The “shoe selfie pass” can be added to the reservation for each individual passenger and is the only way to guarantee allocation in one of the side seats of the cabin, with unobstructed door access;
5.2.2 - One “shoe selfie pass” should be added for each passenger in the reservation, who wishes to be seated on the side of the cabin;
5.2.3 - If the quantity of “shoe selfie passes” added to the reservation is less than the number of passengers, the allocation of the seats on the side of the cabin will be determined by the aircraft pilot in command. If a passenger prefers a specific seat, they should inform us in advance during the reservation process, and it will be evaluated by the pilot in command;
5.2.4 - Due to the distribution of passengers in the aircraft being determined by weight and balance, changes may occur for safety reasons;
5.2.5 - If the pilot in command or any other qualified person designated by the pilot in command or certified air operator decides to change the distribution of passengers on the aircraft, the fee paid for the “shoe selfie pass” will be fully refunded.
6.1 - Cancellations requested up to 48 hours before the flight will be refunded at 80% of the paid amount. Cancellations requested less than 48 hours before the flight are non-refundable;
6.2 - Requests for reservation changes must be made up to 48 hours before the flight and are subject to availability;
6.3 - The take-off time will be provided at the time of reservation, and passengers are requested to arrive at least 60 minutes before the scheduled take-off time;
6.3.1 - Check-in will close 30 minutes before the scheduled take-off time;
6.3.2 - In case of non-attendance by the end of the check-in time, it will be considered a NO-SHOW, and the paid amount is non-refundable and cannot be used as credit for a new booking. Plan your arrival at the terminal in advance, as delays cannot be justified for any reason, including traffic. Remember that there will be other passengers on your flight and/or subsequent flights who should not be affected;
6.4 - Flights may be canceled or interrupted at any time if a condition affecting safety is identified, as determined by the pilot in command, by the certified air operator, or by our ground team;
6.4.1 - In the event of activity interruption for any reason, the charged amount will be proportional to the flight time, and the difference will be refunded to the passenger;
6.5 - Vertical Rio reserves the right to change or cancel previously scheduled flight bookings due to:
6.5.1 - Inappropriate weather conditions for the activity;
6.5.2 - Air traffic flow restrictions and/or air traffic control authorizations;
6.5.3 - Aircraft maintenance;
6.5.4 - Minimum number of passengers not reached for the flight;
6.5.5 - Any other situation beyond our control or that can compromise the safe execution of the activity;
6.6 - The pilot in command and/or director of operations are solely responsible for the decision to cancel;
6.7 - In the event of cancellation, we will contact you in advance to reschedule the reservation based on availability; if not possible, a voucher for rescheduling within 12 months will be issued, or the paid amount will be fully refunded;
6.8 - Flight changes or cancellations will be communicated via email. Please be attentive.
7.1 - Promotional codes, vouchers, or “promocodes” offer discounts on the current flight fare and should be used in the designated field on the reservation page. All codes have a determined validity or quantity and are not cumulative, nor can they be exchanged for their monetary value, and any potential rewards do not generate change or credit for future use;
7.2 - Vertical Rio reserves the right to request additional documents to validate specific promotional codes, such as proof of participation in specific companies, groups, programs, clubs, etc.;
7.3 - Dynamic pricing: The use of promotional codes, vouchers, or “promocodes” offers discounts on the current fare, even if the fare has changed since the purchase;
7.4 - Participants in contests, promotions, and winners of gift cards or vouchers declare that they have read and agreed to the contest regulations and their specific conditions, in addition to this document, for the provision of Vertical Rio services.
8.1 - Vertical Rio holds the right to use images from all photographic and audiovisual productions reproduced on this website, social media, and printed materials, authorized by their creators. Any reproduction, sharing, or commercial use by third parties without prior and express authorization of these images is prohibited and subject to penalties under the Copyright Law (9.610/98).
9.1 - Vertical Rio reserves the right to change any items of this Terms & Conditions, for the purpose of providing excellent service, without prior notice.
